1. scope of application
These General Terms and Conditions ("GTC") apply to the use of the website www.wepractice.chhttp://www.wepractice.ch/ ("WePractice") operated by MDS.
("WePractice") as well as to all legal transactions concluded via this website. These GTC are considered accepted as soon as WePractice is used or information is accessed on WePractice.
2. services of MDS
WePractice is a platform provided by MDS for the online booking of consultation hours with psychotherapists or psychotherapy practices. Consultations can be scheduled at the times suggested by the therapists, respectively. Regular or video consultations can be booked. The MDS acts as the provider of the platform. The treatment contract arises between the user and the respective therapist or the respective practice. MDS is a company independent of the therapist or the respective practice. MDS is not involved in the provision of the psychological services and does not become a party to the treatment contract between the user and the psychotherapist or the psychotherapy practice. The psychotherapists assume sole and full responsibility for the psychological service provided to the user. Any liability of MDS for the psychological services mediated via this platform is excluded.
3 User account
3.1 An account can be created by registering on www.wepractice.chhttp://www.wepractice.ch/.takes place. The registration can only be applied for by users according to section 3.1.
3.2 The user undertakes to provide correct and complete data during registration.
3.3 If the user's data should change, the user is obliged to enter this change in the "profile settings" on WePractice as soon as possible. MDS is entitled to demand proof regarding the correctness of the data at any time.
3.4 The user is obliged to keep his password secret and protected from access by third parties. Furthermore, he is obliged to inform MDS, if he becomes aware that his password is used by third parties without his consent. MDS reserves the right to deactivate the access to parts of WePractice requiring registration as soon as a suspicion arises that the password is being used by a third party. The user will be informed and provided with a new password, unless the user has deliberately contributed to the misuse. In addition, it is possible to change the password independently in "Profile settings". For security reasons, this should be done regularly.
4 Appointment booking and payment
4.1 By submitting an appointment booking via WePractice, you confirm that you meet the following requirements:
Minimum age of 18 years;
Residence and billing address in Switzerland.
4.2 The treatment contract between the User and the therapist or practice is concluded when the User, after prior registration (cf. Section 4), arranges a consultation or introductory telephone call ("Intro Call") with the therapist or practice via WePractice and the User agrees to the terms of the treatment contract. The User is not permitted to book appointments for third parties.
4.3 The duration of the consultation hour is specified in the specific therapist profile and is usually between 40 and 90 minutes.
4.4 Upon receipt of the appointment booking request, MDS will automatically send an appointment confirmation via e-mail.
4.5 The user is obliged to provide only correct and complete information in the context of his appointment booking.
4.6 The appointments booked by the user are binding after receipt of the appointment confirmation and have to be kept. If appointments are not kept more often without being canceled in advance, MDS reserves the right to exclude the user from the use of WePractice.
4.7 If the user cannot show up for a booked appointment, he can cancel the appointment up to 24 hours before the appointment, either by e-mail to email@example.com:firstname.lastname@example.org or directly in the appointment calendar. The customer will receive a confirmation. Insofar as the cancellation is made within 24 hours before the appointment, the psychologist in question is entitled to charge for the cancelled consultation.
4.8 The user is responsible for the internet connection and the hardware as well as the software necessary for the execution of the treatment, as far as this takes place via telecommunication channels.
5. assumption of costs by the health insurance company
The patient himself is responsible for a possible assumption of costs by the patient's health insurance. The MDS does not conduct any correspondence with health insurances concerning possible assumption of treatment costs.
6. intellectual property rights
All intellectual property and other rights in WePractice are owned exclusively by MDS.
7 Disclaimer of MDS
7.1 The information published on WePractice may be changed at any time and without prior notice. MDS makes no warranty (express or implied) as to the accuracy, completeness or timeliness of the information published on WePractice.
7.2 The services and information on WePractice are provided within the technical, operational and financial possibilities of MDS. An uninterrupted or error-free operation of the services provided by WePractice is not guaranteed. MDS reserves the right to discontinue and/or change any of the offerings available on WePractice at any time.
7.3 MDS excludes its liability (including liability for its auxiliary persons, employees, suppliers and subcontractors) for all claims arising out of or in connection with the use of WePractice to the fullest extent permitted by law, including but not limited to damages for transmission errors, technical defects, interruptions or malfunctions.
7.4 MDS is not liable for claims arising from or in connection with the respective treatment contract; in particular, MDS is not liable for damages arising in connection with the psychotherapeutic services provided by the psychologist.
7.5 If links on WePractice lead to websites of third parties, MDS is in no way liable for the correctness, completeness and legality of the contents of such websites.
8. data protection
For the processing of personal data, the data protection declarationhttp://www.wepractice.ch/datenschutzerklaerung/ shall apply.
9 Change/addition of the general terms and conditions
MDS reserves the right to change these GTC at any time.
10. final provisions
10.1 For legal actions of consumers, their domicile or the city of Zurich shall be the place of jurisdiction. In all other cases, the city of Zurich shall be the exclusive place of jurisdiction.
10.2 These GTC are subject to Swiss law.
10.3 The remaining provisions shall remain unaffected if individual provisions are invalid.
